Employer 'English proficiency' mandate under fire?A recent move by the Equal Employment Opportunity Commission in Wisconsin should put employers in all 50 states on alert.

The EEOC stated in a lawsuit filed last month that a Wisconsin company’s requirement that its employees speak proficient English amounts to discrimination based on the “linguistic characteristics of a national origin group.”

Because the EEOC has authority to bring suit and conduct investigations in all 50 states, Florida employers should pay close attention to this developing issue, as it may represent a new frontier in workplace discrimination law.
